Public Property Recovery Bill 2009

Hyderabad, Nov 16th: The Andhra Pradesh Government will introduce ''Andhra Pradesh Public Property (Prevention of Damages and Recovery of Losses) Bill 2009'' in the ensuing Winter Session of the Assembly, to recover costs of damages caused to public properties like APSRTC buses by agitators. The Andhra Pradesh Cabinet, which met on Nov 16, is understood to have given its approval to the Bill to be introduced in the coming Winter Session of the Assembly. It was noticed that a lot of damage was being caused to public properties whenever there were agitations and strikes.

APSRTC was one of the organizations which was badly affected and incurred heavy losses as a consequence of burning and damaging of buses during riots and other violent demonstrations sources. Though there was the 'Prevention of Damage to Public Property Act 1984', enacted by the Centre, it only provided penal action. There was no effective legislation for speedy recovery of such losses from those who caused the damages. The criminal procedure also did not cover recovery of losses.

In order to instill a sense of discipline and enable recovery of damages from the perpetrators, the government has decided to introduce the Bill and the Ministry of Home Affairs, Government of India, has given its approval for it. The enactment would also enable recovery of damages on account of burning or damages of the public property (moveable and immovable) belonging to the government of Andhra Pradesh, Public Undertakings, and local bodies owned and controlled by the state government.
